Appeals - Educational Requirements
GUIDELINE DEFINITION
Initial decisions to recognize university courses as satisfying educational requirements
50, 51, 52, 53, 54, 55, 58, 59, 60, and 69 are made by the District Certification
Officer. An individual may appeal a decision to the District Certification Committee.
The decision of the District Certification Committee may be appealed to the State
Certification Committee by either the individual or the District Certification
Officer. The appeal to the State Certification Committee must be in writing and
sent to the State Certification Consultant. No new evidence may be used in the
appeal process to the State Certification Committee. Only information already
provided to the District Certification Officer will be considered. Each party
will be given a minimum of two weeks to provide the necessary written communications
to the State Certification Committee.
EXAMPLE
Larry requested that course 400-504 (Educational Practices), which he completed
at the local university for two credits, be recognized for requirement 54 Educational
Evaluation. This request was denied by the District Certification Officer. Larry
then asked to appeal the decision to the District Certification Committee. The
District Certification Committee reviewed the same course description that he
provided to the District Certification Officer. They also agreed that course 400-504
should not be recognized for requirement 54. Larry has now appealed this decision
to the State Certification Committee. He has sent a copy of the course outline
and the course description with his letter requesting an appeal. The course outline
was not provided to the District Certification Officer. Therefore, the State Certification
Committee will not consider the appeal until this new information has been considered
by the District Certification Officer and if necessary by the District Certification
Committee.
RATIONALE
Certification decisions should be made at the district level if at all possible. Appeals must
be based on the same evidence being provided at each level of the appeal process.
